Article 1.: General Information About the Loyalty Program

Rewards Club is a loyalty program (hereinafter: the Program) operated by Sunčani Hvar d.d., Ive Miličića 3, OIB: 29834131149 (hereinafter: the Company).

The purpose of the Program is to reward the loyalty of users of the services provided by the Company; however, it does not constitute a prize game. Each participant in the Program who meets certain conditions gains the right to various benefits. The list of services included in the Program can be found at the following link:

Membership is granted upon fulfilling the conditions prescribed in Article 2 of these Rules, and joining the Program is free of charge.

LIST OF PROPERTIES PARTICIPATING IN THE LOYALTY PROGRAM

The Company reserves the right to modify the list of participating properties at any time.



Article 2.: Membership Conditions and Joining the Program

Any individual who is at least 18 years old, regardless of nationality, can become a member of the Program.

Membership in the Program can be initiated:

When completing the application form for the Program, the user is required to fill in all mandatory fields: first name, last name, gender, date of birth, mobile phone number, and email address.

Each member is obliged to inform the Company in case of any changes to the personal data provided in the application form. The Company assumes no responsibility towards the Program member for the inability to use the Program benefits if the member has provided incorrect or incomplete information.

Before completing the membership registration process, the user will be informed about these Terms and Conditions as well as the Privacy Policy, which they will receive via email.

The registration process is completed once the user confirms their membership through the link received via email after submitting the application form.



Article 3.: User Account

Each member is entitled to one user account. The user account can be accessed by logging in on the official website of the Company. Upon first access to the user account, the member is required to create their password.

In the event that a member forgets their password, they can reset it at any time by attempting to log in to the loyalty program online and clicking on "Forgot your password?" and following the further instructions.

The user account displays the following:

The user account is not a payment method and can only be used by the Member to whom the account is linked. A member cannot authorize a third party to use the account or the rights arising from it, nor can they transfer the rights acquired through the Program to a third party.

The member is responsible for all actions related to their user account, and the Company reserves the right to deactivate the account if the member does not use it in accordance with these Rules, which may result in the loss of rights to unused benefits.

The Company is not responsible for any unauthorized use of benefits in connection with compromised user accounts.

A Program member cannot reserve accommodation for their friends or family using their membership data and available earned benefits, nor can they acquire the right to new benefits without staying with them in the reserved accommodation.

The member has the right to request the retroactive recognition of benefits based on membership if they believe that certain benefits were not granted in accordance with these Rules. The request should be submitted via the following email address: [email protected]

The request will be reviewed and decided upon by the Reservation Center manager, who is obliged to send a written response regarding the request within 10 days of receiving it. The request must include the member’s personal details necessary for identification, as well as the relevant hotel accommodation reservation number.



Article 4.: Membership Levels

The Program consists of two membership levels with the following benefits:

Silver Membership Level

This level applies to all newly registered members who participate in the Program. Members of this level are entitled to a 5% discount on accommodation bookings, a free upgrade to a higher category unit (subject to availability) and a 10% discount at any à la carte restaurant of the Company.

Gold Membership Level

Members of this level are entitled to a 5% discount on accommodation bookings through the "Refer a Friend" model.

The "Refer a Friend" model works in such a way that a Silver-level member sends a recommendation for the Sunčani Hvar Hotels Rewards Club to three email addresses of their contacts. Once one of the three users accepts the membership, the Gold membership level is automatically activated, granting an additional 5% discount.



Article 5.: Privacy Protection and Personal Data

The protection and processing of personal data collected by Sunčani Hvar from loyalty program members are governed by the Privacy Policy, which can be found on the Company's website.



Article 6.: Termination of Membership

Any member of the Program can cancel their membership at any time through the online member interface of the loyalty program, by sending a notification to the email: [email protected], calling +385 21 750555, or by sending a registered letter to Sunčani Hvar d.d., Ive Miličića 3, 21450 Hvar.

Membership is canceled upon receipt of the cancellation notice. Upon cancellation, all rights and benefits acquired by the member under the loyalty program cease to be valid. In the event of the member's death, the acquired rights and benefits cannot be transferred to third parties, and the acquired rights and benefits will automatically be canceled, and the deceased member’s user data will be deleted.



Article 7.: Disclaimer of Liability

The Company does not assume responsibility for any material or immaterial damage incurred from the use of rights and benefits from this loyalty program:

a) due to an omission made by the member that prevented them from exercising the rights and benefits of this program
b) due to a system error
c) due to force majeure
d) for the accuracy or correctness of the data provided by the program member.



Article 8.: Final Provisions

Any potential disputes between the Company and a program member related to the interpretation of provisions and the application of these Terms and Conditions will first be resolved amicably. If this is not possible, the competent court in Split shall have jurisdiction.

These Terms and Conditions are subject to change. Any significant changes to these Terms and Conditions regarding membership conditions or changes to the loyalty levels of this Program will be publicly announced on the Company's official website. Program members will be individually notified of any changes to these Terms and Conditions via the email address they registered with, and will provide their consent for continued membership in the Program in the same way. The Company is not responsible for any losses or damages incurred by Members upon the implementation of these changes.

These Terms and Conditions are effective as of the date of adoption.
